HASTINGS, MI (WKZO) A Barry County man who struck and killed an undercover County Sheriff’s deputy may be headed to prison.  Justin Malik was charged and found guilty of driving while intoxicated and driving on a suspended license causing death.

A Jury in Hastings found Malik not guilty however, of negligent homicide in the death of Deputy Christopher Yonkers.  It took two years to bring to trial because of a pre-trial dispute over the traces of THC, the active ingredient in Marijuana found in Malik’s blood tests.

He had been drinking, but not enough to be legally drunk.   It could be used as grounds for an appeal.   Malik could get up to 15 years when he is sentenced on the 16th.
