APPLETON, WI (WTAQ) - A civil lawsuit against a man who cannot be criminally charge for sexually assaulting a young teenage girl will move forward. Last year, 55-year-old Roman Zareczny was connected through DNA evidence to the assault of a 12-year-old girl at the Reid Municipal Golf Course in April of 1989. However, the statute of limitations prevented prosecutors from filing charges. So the victim, now 35-years-old and living in Green Bay, filed a civil lawsuit in Outagamie County. The Appleton Post-Crescent reports that at a pretrial conference Monday, Zareczny complained to the judge that he “wasn’t even given the courtesy of a reply” when he offered to apologize and try to settle out of court. The victim asked for a summary judgment, but the judge has yet to rule on that motion. She is asking punitive damages as well as unspecified financial compensation. Zareczny is also facing criminal charges for sexual assault involving a November 1989 incident.
